These Terms & Conditions (“Terms”) govern your use of asublimelife.ca (the “Site”) and your purchases from Sublime Energy Spa Inc., operating as A Sublime Life (“we”, “us”, “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be the age of majority in your province or territory of residence, or use the Site with the involvement of a parent or guardian, to place an order. You agree to provide accurate and complete information when ordering.

2. Products and health disclaimer

Our products are dietary or natural health supplements. Information on this Site is not a substitute for professional medical advice, and our products are not intended to diagnose, treat, cure or prevent any disease. Information on the Site is for general information only.

Please consult a qualified health care practitioner before using any supplement, especially if you are pregnant, nursing, taking medication, have a medical condition, or are giving a product to a child. Follow the directions on the label and stop use if you experience an adverse reaction. Results vary between individuals.

We make reasonable efforts to display product descriptions, images and colours accurately, but we do not guarantee that they are error-free. Product ingredients and packaging may change from time to time; please always read the label on the product you receive.

3. Orders and acceptance

Placing an order is an offer to buy. We may accept or decline any order, and may limit quantities, for reasons such as product availability, pricing errors or suspected fraud. If we cancel an order after payment, we will refund you in full to your original payment method.

4. Pricing and taxes

All prices are in Canadian dollars (CAD) unless stated otherwise. Applicable taxes (GST/HST/PST/QST) are calculated at checkout based on your delivery address. Prices and promotions may change without notice. If a pricing error occurs, we may cancel the affected order and refund you.

5. Payment

Payment is processed securely by our third-party payment providers at the time of order. We do not store your full credit card details. By providing payment information, you confirm you are authorized to use that payment method.

6. Shipping, returns and refunds

Shipping is governed by our Shipping Policy, and returns and refunds by our Refund & Return Policy. Both are part of these Terms.

7. Accounts

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Contact us right away if you suspect unauthorized use.

8. Intellectual property

All content on the Site, including text, images, logos, product names and graphics, belongs to us or our licensors and is protected by Canadian and international law. You may not copy, reproduce, distribute or use it for commercial purposes without our written permission.

9. Acceptable use

You agree not to misuse the Site, including by attempting to gain unauthorized access, introducing malicious code, scraping content, or using the Site for any unlawful purpose.

10. Privacy

We collect and use your personal information in accordance with our Privacy Policy and applicable Canadian privacy law, including PIPEDA. We will only send you marketing emails with your consent, and you can unsubscribe at any time, in line with Canada’s Anti-Spam Legislation (CASL).

11. Third-party links

The Site may link to third-party websites. We do not control and are not responsible for their content, products or privacy practices.

12. Disclaimer of warranties

The Site and products are provided “as is” and “as available”, to the extent permitted by law. Nothing in these Terms limits any rights you have under applicable consumer protection legislation that cannot be waived.

13. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the Site or products, and our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded by law.

14. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms or misuse of the Site, to the extent permitted by law.

15. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new “last updated” date, and applies to orders placed after that date.

16. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there. You agree to the exclusive jurisdiction of the courts of Alberta, subject to any consumer rights you have to bring a claim in your own province.
